Understanding : A Guide to Your Options

Bankruptcy is a legal process with three primary reasons for initiation:

  1. Voluntary  When you’re unable to meet financial obligations and choose to declare voluntarily, you can file for bankruptcy.
  2. Creditor-Initiated Creditors can seek to have you declared bankrupt if you owe them £5000 or more.
  3.  IVA Violation: If you violate the terms of an Individual Voluntary Arrangement (IVA), an insolvency practitioner can start y proceedings.

Outside England and Wales (International Considerations)

If you reside outside England or Wales, you can declare being bankrupt there under specific conditions, including living in these regions or having a business there within the past three years. However, please note that an Order from England and Wales might not be recognized in countries outside the UK. Residents of Scotland or Northern Ireland cannot declare bankruptcy in England or Wales.

Debt Relief Order (DRO)

Individuals with debts under £30,000 and minimal assets may qualify for a Debt Relief Order (DRO). It offers a less severe alternative to bankruptcy for those with relatively low debt levels.

Initiating Bankruptcy

For voluntary bankruptcy, you can apply online if you meet the criteria. If someone else initiates proceedings against you, you’ll receive a petition copy. You can choose to contest it, but you might need to settle the debt or prove to the court that you don’t owe the money. Understanding your rights and responsibilities during the bankruptcy process is crucial.
